The Situation – Theft of time

An employee was suspected of theft of time.
Covert surveillance cameras were inserted in the workplace in accordance with a warrant issued under the Workplace Surveillance Act. Surveillance determined that not only was the employee not working in the best interest of the employer but was also taking copies of designs and other intellectual property of the employer from the workplace with the aim of commencing a competing business.

The Solution

The Streeterlaw team urgently sought an injunction, the seizure and return of the company confidential information designs and intellectual property. Streeterlaw were successful in obtaining a Supreme Court order for an "Anton Pillar" search order.

The search order was executed against the employee's residential address and eight archived boxes of company material was recovered including confidential supplier and price lists and marketing plans.

The Result

The ex-employee was restrained by Court Order from benefiting from stolen intellectual property. A continuing injunction was entered into which restrained the employee from using any of the information he had obtained unlawfully. The employee paid both damages and the legal costs of the employer.
