How to arrange a legal divorce in Australia?

Under Australia's no-fault divorce law system, the only grounds for divorce is the "irretrievable breakdown of marriage." Australia’s divorce laws generally requires a physical separation of at least 12 months, although in some cases this period may be accrued where the couple continue to live in the same house.

Australian divorce proceedings may be initiated by either party, or through a joint application. A delay of approximately three months will occur between the date of filing and the divorce hearing, whereupon the Family Court will grant a 'Divorce Order’ which becomes effective 1 month thereafter.
