Creditors and Third Parties in the Family Court

Family Law situations are not always limited to only the two parties immediately involved. Australia’s Family Law Act provides the Family Court with the ability to override and bind rights, liabilities and property interests of third parties. These third parties may include creditors owed money by one or both parties.

This is a very useful legal tool to enforce the ambit, or full limit, of the Family Law Courts’ powers.

A third party has the right to be accorded procedural fairness in respect of any proposed orders and will have the opportunity of making submissions and submit evidence to the Court.
