Legal impact of bushfire continues
In January 2003 the nation watched in horror as bush fires raged around Canberra. The Australian National University (ANU) was one of the organisations which suffered in the fires. Much of the physical damage to Canberra has since been repaired but the impact of the fires continue.
Six years later a court decision in a case between ANU and their insurer AON has created a much more significant legal precedent for Australia. In law precedents can often pop up in relatively ordinary cases which lead to far greater impact on other cases. This case is an example.

Here is a very quick summary of the case:
1. ANU settled with their insurers AON
2. ANU sought an adjournment to make substantial amendments to its claim against AON
3. The Court decided it is in the public interest that there be proper and efficient use of public resources
The bottom line. Lazy lawyers who are unprepared will need to lift their game. If lawyers do not comply with directions and properly prepare and present their cases the FIRST TIME then they will lose the opportunity to “fix it up” later.

ASIC case creates anxiety for Business Advisors
ASIC has found a North Sydney Solicitor guilty of advising eight of his clients engage to in activity which breached the Corporations Act. The result of the implementation of this advice was that the purchaser acquired all the assets of the old company free of any of the liabilities of the old company leaving trade creditors, taxation debts and debts for insurance premium to sue an asset-less company. This significant case sends a warning to all business advisors.

Bankruptcy limit to be raised
The Attorney General’s Department is proposing amendments to the Bankruptcy Act. One of the most significant changes is a proposed increase of the minimum debt amount a creditor may issue a bankruptcy notice for. Currently it is only $2,000. The proposal is to raise it to $10,000.
